Rebuilt A4ld not shifting out of first. HELP!!!!

I swapped the transmission and the thing will not shift. Even when manually shift from 1st to 2nd with no change in rpm or speed. Things I have checked Vacuum, fluid,and electrical connections. What could be the problem. I want to drive her, but I don't want to burn up a new tranny. Please help

Who did rebuild?
Fluid level as specified on dipstick?
Correct shifter linkage?

Please don't take offence, You checked the dipstick while running and warmed up? Exact directions are on the dipstick.

Are you sure you have good manifold vacuum at the modulator?

yeah I checked while at operating temp and at idle. and the vacuum is good at manifold and modulator. could it possibly be a bad modulator.
