What are the rules for removing said signs? Can I just follow and yoink?
As long as the few conditions are met.. there really isn't a single thing you could legally do lol. Absolutely boggles my mind
The basic rundown of conditions are as follows..
-Needs to be within the public ROW. The public ROW is 33' from the roads center line.
-Sign needs to have the name & address of the individual who placed it OR the name of the organization who placed it, as well as the date it was placed.
-Signs can only be placed during certain times of the year, and only for a certain period of time... 6 weeks before an election, and must be taken down no more than a week after the election.
There are a few more as well If you want to put a sign up on land you dont own.. like.. can't be put on trees, telephone poles, or traffic control devices. Can't put one on the side of i-95 or put one so it can be seen from i-95.. same (or similar message) signs need to be spaced at least 30' apart.. yadda yadda yadda. Not all roads technically have a public ROW either.. just most of them lol. State routes and roads that connect to state routes are fair game.. and that's like... all our roads up here.
So yeah... with how these statues are written... it's 100% legal to walk right onto some random persons lawn and place whatever you want for signs. Tampering with the signs is a civil violation that carries a 250$ fine.
Not even allowed to pick the sign up to mow the lawn. It's gotta stay there until the person who placed it comes and gets it..
There's been bills run through the state-house to re-write the statutes and make it so these atupid assed signs can ONLY be placed on private property.. by the property owner.. but they all fizzle out.
I'd really rather them just get outlawed 100%.. but.. first amendment and all that
