will a pending case stop me from obtaining this job

So got a job offer from howell. Which is an ammunition manufacturer. Same thing I was doing before I got fired. Since they work with explosives they require a federal back ground check. I just submitted my approval for back ground check then came home to find a sheriff with papers in his hand for a court case pertaining to the incident at my last job. I'm being charged with a battery 1. Which I am going to fight as Ive done nothing wrong. The first court date iisn't until the 22nd. worried that this case will show up on the background and stop me from getting the job.

I don't think it will show up but who knows?

I'm not a law professional, but:

You're innocent until proven guilty last time I checked. If the HR person at your job says anything about the pending investigation and alleged battery I, politely remind them that you're innocent until proven guilty.

Not the way it works. If you do a crime at work (theft, fraud, battery) the HR can do what they have done. If they don't and he steals, commits fraud or kills somebody at another job and his prior HR said nothing to another company that hired him, then that company will wind up being sued. He has been served papers from a sheriff so it has gone past that.
 
Unfortunately the background check probably will flag this. Yes you are innocent until proven guilty in a court of law but the hr people are probably going to not even want to spend money further vetting you for the position unless they do not have enough other suitable applicants. If you do get called they will probably want to hear in glorious detail what happened. And then wait pending outcome of the court date. I would be getting ahold of a lawyer to find out what you can do to get that mess removed from your record as fast as possible as it will rear its ugly head again.

Anything that is on your record, no matter what it is, even if it's not your fault, will be flagged. Your new employer might sideline your app till it is resolved in the courts. Or just hire somebody else that is equally qualified without any record issues.
 
Yes, all state and federal papers will show up on a search, civil doesn't "usually".
And they stay there forever.
If you are arrested and then found not guilty or the charges are dropped, that will be on your record, the arrest and the rest of it, it isn't taken off because case was dropped or you were not guilty.
You can file to have things expunged from your record, and, if accepted, those records are hidden from any "public" search but would still be available to law enforcement searches.
 
Sheriff must be related to the cop that wrote you up for $10 for not wearing your belt. You seriously need to change your luck.
 
If HR bring it up, talk to them about it. I've had bosses who didn't care what you did so long as you were on time & did your job.

Wish it were that easy. This is a small time mom and pop company but since they work with explosives they have to follow federal guidelines. If you don't meet the minimum standards there is nothing they can do about it. And federal law or some crap states that any one with a violent criminal history can't handle explosives
 
So the pending case did not stop me from getting the job. They didn't even mention it. :) yay now I can mod on.

Now hopefully this internship at tthe custom boat shop follow through.

Which shop? Engines from my work end up in a lot of boats built over in Lewiston... I was over there for a couple days a couple years ago helping one of them out.
 
My worry would be what would happen if you lost the case...
