I'm not saying it was the other guy's fault that it happened, But I am saying that it could have been avoided. Everybody involved in an accident has to be able to take some of the blame. If he got out and stated "I didnt see you" That statement could be used as what is practically confessing to being at fault.
I'm not saying to ring the guy and his insurance, but I believe that a poor choice on the road can be saved by people paying better attention. I believe both are at fault, the OP didnt look long enough, while the other guy wasnt paying enough attention to react. I know that everyone thinks that when the situation rises that they will be able to avoid a wreck. But when it does arise, you dont hardly have any time to react.
You should work for State Farm. They like to spread the blame around in an accident so a poor college student only gets 75% of what he needs to fix his vehicle because "he should have seen the accident coming". If someone pulls out in front of me and I hit'em, there's no way I would accept partial responsibility. Shit happens, someone's gotta pay, and that someone isn't going to be me in a scenario like that.
