So he pulls in front of someone, gets hit and it's the other guy's fault? Think about it. How long does it take to cross 2, 3 or even 4 lanes of traffic if cars are coming and you are diligent about getting across quickly. A few seconds right? Therefore if the kid took his eyes off the road for even 1 second, he would have hit him, which he did. Taking your eyes off the road for 1 second or even two is not negligence. Trying to beat traffic and causing an accident is.
First off, to clear things up.
-I stopped at the stop sign leaving the neighborhood
-Looked
-Crossed into the median
-Stopped
-Looked again, saw traffic a ways down the road, (its a 35 MPH zone btw) failed to see this vehicle (im human...just like everyone else and we make mistakes)
-I then proceeded to cross the 2 lanes into the shopping center, the kid hit the rear passenger tire on my truck. So that being said, you know that maybe I did pull out to soon and shouldve waited, but you also know that I clearly had enough time to get THAT far across the street without punching the gas pedal, now if that kid were going the speed limit there is no way in hell that he wouldve hit me if he put his foot on the brake.
I cant judge speed or when the car is going to get to me, but when I saw that car, there was no way in hell that kid was going 35, I was looking right at him the whole time (AFTER I LEFT and crossed 1 lane) until....I was of course, flipped over.
I admit it was my fault, and couldve been avoided if I had seen him or looked harder, but he couldve also avoided it by putting his foot on the brake. He said that he saw me and didnt see me until he was basically hitting my truck, but then 10min later he says that he say me and assumed that I was going to wait in the median.
