Im 16, hes 17 and no...I surely did not win the fight cause the first punch broke my skin and kinda threw me off balance, then he picked me up and slammed me on the ground and got on top.....wasnt much I really could do, I couldnt see outta my eye and its still kinda blurry.
The cut, isnt DEEP but its sorta bad, I mean it still bleeds every now and then. The cops said they couldnt do anything cause me and this kids friend had a confrontation like almost a year ago and the cop said the kid might have wanted revenge or some crap....basically said I was in the wrong for doing anything even though, my truck was hit, my a$$ was kicked and nothing is wrong with him at all....lol
I have pictures heh, my friend took some
Considering assault is assault, it doesn't matter if he was looking for revenge or not, for him throwing a rock at your truck and then sucker punching you that is property damage and physical assault. I would be talking to another police officer. That kind of sounds like the officer just didn't want to do anything.
I've been in those situations before. I was in a fight a long wile ago, this kid took me a cheap shot right in the throat, I just dropped. About 5 minutes later, after I could breath again, I got up and took a metal chair across his back got him on the ground and just went at it on top of him, until my fists were sore. I got suspended from school for that, even though he started it, (my school was retarded, and couldn't see that it was self defense considering the track record this guy had on picking on me, I finally snapped, they're lucky I didn't go Columbine). After my weeks "holiday" I cam back and he was waiting for me inside the classroom, I walked in, and he good an edge of a text book to my ribs (he broke one), and then the took the text book to my face (broke my nose), and then he just kept on hitting me with it. After that, my parents pressed charges on him, the school tried to expel me, but my parents threatened to sue (they couldn't see that it was the kid who was picking on me who was the problem, they wanted to get rid of the victim), and it ended in a very long fight that we ended up winning, and because of that, the entire Calgary Board of Education changed their rules about fighting. When I took the chair across that retards back, they said it was the start of a new fight that I had no rights doing. I said it was the same fight but it kind of hard to continue when you can't breath. The school also has to keep records on each students actions, and look for patterns in student's behavior. Maybe I wasn't in the right for taking a chair across his back and trying to kill him on a classroom floor, but I was in my right to defend myself from someone who had picked on me, and abused me for over a year and the school would do nothing about it, all they would do is tell him to stop and then that would make it worse. I'd say talk to your parents, talk to another police officer, and maybe even talk to an attorney if you want things to get that complicated. Even though he's seeking revenge he still has to take responsibility for his actions.
