Intake manifold question

I have a 96 ranger with the plastic upper intake. My question is, can I switch it to the older aluminum upper? It looks like EGR provisions are different. But is there away around this and still be legal?

Why?

the plastic upper intake flows better.

The plastic upper intake also doesn't get hot from underhood heat
and conduct that heat from the hot engine bay to the incomming air charge...

The P.O. had a shop (NAPA) tell him the 1st and 4th cylinder intake gaskets were leaking. I really don't care for plastic - it was made to make pens and bags to carry groceries, not car parts IMO. I know the 4.6 has had several issues with it's plastic intake warping. Am I special, or is this the same case on the 4.0? I just figure I would rather replace it with metal and not deal with it anymore.

Then again, this same shop also tried to fix a cylinder 4 misfire by replacing the EGR valve, so maybe it's not really leaking.
 
If they are leaking Just replace the gaskets. Once every 13 years isn't bad. I have yet to see a bad manifold.
