intake cover gaskets

so decided to replace my valve cover gaskets today on my 98 4.0. did my buddies 94 4.0 and noticed something odd. on neither of out trucks was there an upper intake gasket. is there a reason for this?
 
I believe it is because the Fuel Rail sits in between the upper and lower plentum, and the faces are all machined
 
ok well nonetheless i put the gasket that came in the kit in and now my check engine light went off, which i believe was because either the 2 surfaces were not perfect or the studs were loose or combo of both.
 
I have so many codes that I just pulled the light and said screw it...
 
On the 95+ plastic plenums there should be o-rings, not gaskets, on the bottom of the plenum. Probably why you didnt see it.

well i saw those but they werent soft like an o-ring. and were actually under the surface so im guessing they were useless. watever truck runs better and light is off for first time since last fall. im happy
