Emmision test in New York State

I am throwing the code for "Evaporative Emmisions Control System Vent" However, the CEL light is not on, nor has it come on in over 500 miles since I scanned and read the fault code.
I think I read that in NYS I could still pass the emmisions check with 6 out of the 7 checks complete and the CEL was not lit.
Anybody know if this is true?
