just got a cell phone off ebay. works great and no damage to it at all. i thought everything was good to go, but no. i took it to verizon this afternoon to activate it and it came up (stollen/lost) WTF!
so now im f**ked!
i dont kno what i should do
seller has no return policy

How did you pay? If it was through Pay-Pal then you can contact them.

You can file a dispute through Paypal's website. Just make sure that you mention that the cell phone is stolen. Also it may be a good idea to provide the ESN number incase they wanted to look into it.

Shouldn't stolen items be under the list of forbidden items to sell on ebay?
If Paypal won't help you, I would contact ebay directly with proof that you've received stolen property. I'd pitch a bitch, threaten to contact authorities, whatever it takes. Nothing may still be done, but it doesn't hurt to try.

i just sent a email to the seller telling him that i would do just that if the block was not taken off within 48hours

Paypal doesnt care about if the property is stolen nor do they care if you get your item. They just make an attempt to make sure neither you or the businesses personal information gets stollen. eBay will however enforce a return policy upon a stolen item.

WHOA!! now now lets not say things about e-bay we can't take back, kidding. e-bay is real good about getting your money back especially if you used paypal (because they are the same company). They will resolve it but it's gonna take a couple weeks.

I got boned on e-bay quite a number of years ago- paypal were worthless assholes to deal with and wouldn't do anything about it. Then I contacted the credit card company and they reversed the charges. Funny thing, a few weeks later, I get this e-mail from paypal stating I should have let THEM resolve the issue first...

Unless you find out that you are the proud owner of a lovely estate somewhere in the middle of africa after you bought those mudflaps off ebay from the dude who spelled them "phlaps", paypal doesnt care that your item is broken, stollen, or not even remotely close to what you ordered. I'm sure we all have horror stories when dealing with them. My personal favorite is how long it takes to get an actual person (i absolutely hate their voice recoginition bs... too me a half hour to get an actual operator)

report it to ebay, they will give seller a chance to rectify it or cancel his seller status
