So today after a long day of rodding and stringing in the city manholes we get a call from the owner saying we are not getting our checks until Tuesday because the funds are not there. We were contracted out to run a 24-way of 4 inch pipe about 1000 feet. Top 16 of the 24 way turned off and bottom 8 stayed straight. (according to the blueprints) We followed the prints and everyone approved the prints before they were handed to us. Everything was installed and concreted. We left the jobsite because we fulfilled the contract. The fiber lines were run and everything was done. BUT they are saying we did it wrong and the top 8 were to stay straight and the bottom 16 to turn off. (not according to the prints) The company we did this work for is not paying us for the work done because they are claiming it is wrong from what they wanted but perfect to the prints. Is there anything we can do or is it just word against word?

They approved the prints and the job was done as drawn and approved. They are screwed. You will get paid.

Do they have any proof that you did the job wrong? Ie, is there a more current revision level of the blueprints that you used to do the job? If they can't produce a blueprint with a higher revision level than what you used to complete the work and prove (certified mail, etc.) that they transfered the updated revision to your company then you did the job correctly and are owed the money.

I'd say even if the drawings/blueprints were changed without you being notified of the changes and what you did was per contract, they are in the wrong. 40 years working in engineering/design. Important is "per contract".

Thanks for the responses I just wanted to make sure. The job was done in key with the prints. 2 weeks later and us still not getting the pay they are saying we did it wrong. This outfit is him-hauling around trying to put the blame on us. Outfits Superintendent is not going to say he made a mistake for the sake of keeping his job so of course it comes to finger pointing.

If you build whats in the provided information [the plans] that they provided and that your company bid on they have to pay you.Whats funny is if he would have told you he wanted something different than the plans. You have to make a paper trail plus check authority. His boss says he doesn't have the authority your on the hook.I'm sorry about your late payday but your working it's been since November for me very frustrated.
