My local PD is giving me problems with pistol permits

Move to Alaska. If you can legally own a firearm, you can carry it concealed. No muss, no fuss. Everyone is armed here and pretty polite for the most part.

Might think about the news outlets of all else fails. Letters to the editor or talks with a sympathetic reporter can go a long way to getting the attention you want to get things moving.

sadly, NJ is one of those democratically controlled states that seem to love high taxes and as few civil and personal freedoms as possible. While your 2nd amendment rights might not be infringed upon, local PD's love screwing with you and sometimes impose their own set of restrictions. One example would be number of permits you can get at once and so on. Here's a C+P on my local bike forum.

Anybody here have any experience obtaining a handgun permit in NJ, I found something sketchy goings on in my town regarding processing time of permit applications, and wondering if any of you guys have any ideas.

So I went to my local PD to get the applications for my handgun permit to buy. When I got home and started filling everything out, I decided to cross check with some info I found online. There were two sort sketchy things I noticed, and I'm wondering if you guys have any ideas how I should handle myself whilst getting fingerprinted tomorrow, as this will come up.
First the info regarding the "discrepancies"

At the bottom of the "What to bring with you" cover sheet on the package I got, it says, "Expect a long period of time for processing, do not call for status updates unless more than 6 months time has elapsed."

So this struck me as strange, because I know the waiting period is 30 days, and I did some searching and found this,

Jersey applicant be processed (granted or denied) in 30 days. Thats the law.

2C:58-3(f). Purchase of firearms

"...the licensing authority who shall investigate the same and, unless good cause for the denial thereof appears, shall grant the permit or the identification card, or both, if application has been made therefor, within 30 days from the date of receipt of the application for residents of this State and within 45 days for nonresident applicants. A permit to purchase a handgun shall be valid for a period of 90 days from the date of issuance and may be renewed by the issuing authority for good cause for an additional 90 days.

Some municipalities take months to process applications. This is an illegal process
which as been propagated due to the lack of people challenging the system. If you don't
want to wait months for your permit, you don't have to. Take your municipality to court
and demand your application be processed according to State statutes.

Now I realize that I can just get a lawyer to help me out, but I'd like to avoid litigation at all costs, and pulling the lawyer card right away could get me some rough road ahead.

So I am wondering if you guys have any suggestions on what I should say before it comes to, "well you'll be hearing from my lawyer."

Also, how should I react when asked this, "Why does a woman (black man, senior citizen, handicapped person, nice person like you, etc.) need a gun anyway?"

As I'm pretty sure this will be the first question out of the officer's mouth when I protest 6 months.

The other less pressing "discrepancy" is the law state there should only be two applications, but there is a 3rd background check consent form written in the city's letter head. Which I thought was covered in the state's applications. This just maybe a supplemental consent form to save the PD from some legal thing, and since I'm waiving the right to do it anyway, there's not problem doing it twice.

I also did research to find out what the wait time was going to be. I was told by the officer who was a nice guy that it would take about 90 days. He gave some BS excuse about the Feds being backed up because everyone was getting permits after 9-11. Law says it should take 30 days but it will probably take anywhere from 3 to 6 months. Thats just the way things go in NJ. You could threaten with a lawyer, hell you could even get one but it would be a waste of your time and money. Just sit back and try to wait it out. I suggest getting 3 or more pistol permits at a time. They only cost $2 and they are good for a total of 180 days.

i applied for 3 this time. and no matter what there good for 3 months from the date of issue. The attorney general got back to me today, there going to inform that department of the law and are happy to put me in contact with a pro bono rights lawyer

California is great, even though it is legal to get a permit, most counties just ignore the applications for as long as they can. Hopefully the nra can get em to cut the bull, but i doubt it.

holy shit you can get a pistol in NJ.LOL. Here in CO its, go to store wait 30 min and you got an AR-15 or tec-9, glock whatever you want

That how it is here in Oklahoma also. Just walk-in, put cash down, quick background check, walk-out with your new firearm. Or at a gunshow, just skip the background check.

Same here in montana.

I do think that he's just lazy, not intending to obstruct your rights. ....BUT, the laziness of a government official is a BS reason for your rights to be obstructed. He should be fired if he cant get his job done because he is pre-occupied with personal stuff. A job is a job, DO IT.

I'm originally from NJ and your ability to get a permit to purchase is highly variable depending on the attitude of the local cops who are the "local issuing authority"

NJ has a two tiered system.

The "FID card" more properly called "Firearms purchaser Identification card"
which though is LEGALLY only a purchaser's ID is treated (ILLEGALLY) by most jurisdictions (and often the State Police) as a "permit to possess" Longarms, which it is NOT.

the "pistol permit" is a four carbon single use permit that also serves as
the registration for the handgun. they are good for 90-days if memory serves
correctly.

Because of the aggrevation in getting them I used to get them three
or four at a time ($2 each at the time)

while there is a statutory requirement to issue or deny within 30days
the State police Bureau of invistigation often drags their feet even
longer than that.

Honestly? I'm glad I live in pennsylvania and I'd only move back to NJ
if shackled hand and foot and was dragged (screaming and kicking)
back there... and afterwards they'd better never let me loose
because afterwards I'd to things to everyone involved that would
put Stephen King into a catatonic state were he to try writing about it...

IN PA we have instant check based on our drivers licences.

and though I've lived here for nearly 13 years I haven't purchased
a handgun since moving out here, but I haven't sold any either.

I have bought several rifles in the last couple years, but aside from the federal paperwork that's little different from buying a new shovel...

I truely feel sorry for anyone having to deal with the NJ Bureaucracy
and my heartfelt recommendation is move.

If there is ANYTHING I miss about NJ, I haven't been able to think
what it might be in the twelve-plus years since I left.

But to be honest I stopped trying to think of anything I miss
about NJ about eight years ago.

Looks like you got it figured out already. NJ is one of the states that makes it as difficult as possible to get a gun permit and the PD is simply trying to wear you down by delaying hope you give up and go away.

Good luck. Background checks and things take time. What you are dealing with is called "Government bureaucracy". Many layers of it too. You won't have any luck getting things faster than if you just waited like everyone else that wasn't whining on the net.

Hey, I was generally ticked off at the whole process and I had a police
department that bent over backwards to be helpful.

Of course it helped that I knew personally about half the department and that
the detective in charge of issuing the permits was a guy that was a year behind
me in highschool.

If I had gotten a ticket for every time I was stopped for speeding in town
while testing a customer's car I'd have been paying for all their patrol cars
for the next hundred years...

The town is 1/2mile wide and 2-1/2 miles long, frankly it was hard to find
someone you hadn't met... not to mention that the house I lived in predated
the town and had been built by a great grand uncle, or that my grandfather
was a founding member of the country club.

Are you forming a mental picture yet?

Anyway those things made NJ "tolerable"... but only barely.

Here in pennsylvania if I wanted to buy a machine gun my biggest
problem would be deciding which Class-III dealer to buy it from...
and how to pay for it.... automatic weapons aren't cheap.

and the biggest problem in getting a carry permit is making sure
you have exact change to hand the Sheriff's Deputy with your
application.

i use to live in tucketon and good luck because if you give them hell they will just lose your paper work and make you wait even longer and unless you know someone in the police department good luck!!! My father new a couple cops in the department and it only took him like 2 week to get a pistol permit...
