I was sitting in line at the gas station and the B&*ch in front of me backs into me. then she drive around and tells me my truck is fine and she pulls up to a pump. I walk over to her MINIVAN (rear hatch pushed inpretty nice) and say what the F&*K? She tells me my truck is fine. Then i told her to get out and look at her damage. Wrote her license plate down, cause she was in a hurry and couldnt wait for the police.
Funny thing is, I only have a scratch on the valance and she is gonna need a new rear hatch.
Oh, and the cameras at the station don;t work (so why have F&^KIN cameras?).


So, who makes a heavy duty bumper/pushbar, or do I have to make one?

I want to be ready for the next MINIVAN!
 
I hope you called the police and got a report of the accident; she SO sounds like the type that will later say you caused it hoping you'll roll over or there will be some technicality.
 
for a bumper it will have to be custom, but if you can find one (they are discontinued now) the waag pushbar I've heard is pretty reliable and can take a hit. You will see them floating around every now and then.
 
I would be iffy taking it for a report, unless you got the phone number of at least one person who saw it. Parking lot accidents/clusterfucks usually go as no fault, even if someone is clear to blame. In the eyes of insurance companies, police, and the courts, she was hit from behind, and you were the one that hit her. Eventhough its not the case. If its minor damage, I would let it slide, if its something more, I would try to find a loophole and fight it. It does suck when thing like this happen and you're clearly not at fault, but in the eyes of the law you are.

I was in a 60km/h zone, and about 30 feet in front of me a guy pulled out of a yield and stopped right in the middle of my lane, now, you can't stop much in 30 feet going 60km/h, let alone an old Chrysler made beast. Luckly this was my old POS Caravelle. I hit him doing about that. I mess his rear bumper up real bad and I dented mine, nothing major on mine. That day I was calling the dealer on the price of a new bumper and install, I got off lucky at it being about $400. I gave him $500 cash and wrote out a contract dealy saying I paid in full for damaged sustained to the vehicle and to person. I knew he was out for money and was going to try to milk me for everythign I had. He never read what he signed, he called me back a few days later and said his neck hurt, I said I'ed see him in court, I'm still waiting for the call 2 years later.

I'm not saying you should try to pay her off, but I would try to settle this without police assistance and without insurance being notified, as this does not sound very major, probably less then $1000 (In Calgary, anything less then $1000 damages to both vehicles does not need to be reported). I've seen a lot of parking lot accidents, as the one for the shop I'm at is probably the worst designed parking lot of all time. I see probably one or two accidents a week there, mainly because people are stupid and can't wait for someone to back out of a stall with 2 huge vehicles on either side creating a major blind spot until you're in the middle of the isle. Almost everyone I've been witness to have been classified as no fault because its still impossible to tell who was completly at fault, unless its so blatantly obvious. Without seeing the damage, I would probably just let it slide, and keep away from her, as she does kind of sound like someone out for money, also, if she didn't let you get her information (licence plate excluded), call the police and at least get her charged for leaving the scene of an accident, if you get that down, and your side of the story first, chances are, thats going to be the side that the courts lean to, as reporting leaving the scene, and your side it seems more like you're the victum. Anyway, sorry for the long post, I sometimes natter on. Good luck on this one.

He pulled out in front of you, and you paid him? That don't seem right :icon_confused:
 
No one stopped, I knew by the situation, and where I hit his car, and with no witnesses, that I was going to be classified as the one at fault. It sucked big time, but it was better then settling it thorough insurance or court. I knew the guy was going to milk me for all I had, I decided to pay him off while i had the chance. Since he was sitting in my lane fully when I hit him, dead squair on his rear end, it looked liked he was sitting htere and I wasn't paying attention. When he called and told me that his neck hurt I was glad I got him to sign the contract thingy, If he presisted on it, I knew that he was injured, but when I told him to read what he signed (2 copies), and that I'ed see him in court, It seemed like a wise choice to pay him off. Since he never called back on that I knew he was out for money. Was it fair...No, but then again, so is life.

Yeah, when you rearend someone, everyone tends to think you didn't have your vehicle under control, which makes it your fault. That's why you have to be very careful and stay the hell back from people who may suddenly jam on the brakes. Also, watch carefully for a stopped vehicle in another lane suddenly pulling out into your clear lane, another gotcha.

Nice thing is, OBDII computers have a black box function that alledgedly continuously records your speed.


Should make it easier to prove the person in front of you is a dumbass who caused the accident, not you.
 
I've often thought of having a video camera permanantly mounted in my vehicle
so it is painfully CLEAR who was at fault and for what....

Especially since I've been in accidents where the only thing I did wrong was violate what I call Rule of the road #1: "Never let someone else's accident become your own..."

A vehicle that is backing up is usually at fault for any collision.

Well, I guess they can't blame me.
1-No Police report - She was is too much of a hurry to wait for them (I didn;t care since I no almost no damage)
2-No cameras at the gas station.
3-As far as I know, none of the mexican gas pumpers volunteered to be witnesses.

I've seen the sterling mfg. site for bumpers and stuff. I'll probably give them a call and start with a set of nerf bars.
 
FINAL RESULT


Her insurance company (Geico) is sending me a check for $306.66.

and no, I'm not getting it fixed. I'll spend the money elsewhere.
