four wheel drive not disengaging

before i get into the winter which is quickly approaching i was hoping i could get some ideas for why I'm having issues with my transfer case not disengaging.
it would however when I'd stop and put it into reverse and back up a bit. my Haynes manual didn't have crap on this. any clues would be greatly appreciated!
 
when you are testing the transfer case, are you on a "loose" surface, ie: grass, dirt, gravel, wet road, snow, etc.....

you need to be on something loose, or you will get "drive line bind"

maybe why when you put it in reverse that unloads the " bind " and it disengages
