A4LD Fluid Level

Have the A4LD auto in the 86 BII. All was fine till the the heads cracked on the 2.9 a little over a year ago. Replaced the the 2.9 with another last March and since then it drops out of overdrive when the fluid gets down to a certain level. Problem is that level is the full mark on the dipstick. Fill it about one inch above the full mark and it will run fine till the fluid is back down to the full mark. It sat in my inlaw's shop for a few months waiting for the engine change but I don't see that anyone would mess with it or take the old one out. The problem with it being overfilled is that it leaks fluid out the shifter linkage where it goes into the transmission. Replaced the seals there but still leaks past. Any ideas why it would run like this?
 
I have to ask, how are you checking the fluid level?
 
In Park, engine idleing, after running it through the gears.
 
Ok. Had to check since what you said makes a lot more sense if you were checking it with the engine off.

The pan hasn't been crushed has it?
