is it illegal?


I figured this thread would be much longer by now.

The whole "if there's no 'no trespassing' signs, then you can go in there" is entirely false.
Do you have no trespassing signs on your front lawn??? I HIGHLY doubt it. With that justification, it is entirely legal for me to bring my truck over, and drive through your front lawn, if I don't even know you... hell, I could drive around behind your house, and wheel in your back yard too...

They do not have to put up no trespassing signs, in order for it to be illegal. And yes, you can get in pretty deep trouble for trespassing.

If there aren't legal trails by you, then I guess you live in the wrong area... I'm not saying the trail/ access road is illegal though. I would find out who owns the land, and contact them. I bet if you take the time to contact, and ask them, they may be ok with you going back there.
 
The land is sometimes owned by privite owners and sometimes it is just large tracts of land owned by power company the privite ones have gates with locks I think you will be fine as long as you are not tearing up the land and acting stupid and have explosives to take down a tower tread lightly and leave when asked to no lip no bad mouthing just leave and say ty for telling you
 
i have wheeled on city land in my older trucks and been caught several times and the only thing i have been told is please leave and the worst ive been told was that i was a young punk and shouldnt have been down there and he laughed and told me not to be down there to much longer
 
All right-of-ways are typically not owned by the company using them, although often the companies do try to block access to them, but not always.

My parents have two right-of-ways crossing their property. One is for a railroad. Our property technically extends to just past the existing set of tracks (there were two tracks at one point years ago and the property line is right in between both). People ride quads and dirt bikes through there all the time (the access road is on our side of the tracks). Technically it's our land, but we're not allowed to do anything with it. And should they ever completely remove the tracks, we still don't get our land back, it becomes a "rails to trails" program.

The other right of way is for a sewer company and it got ramrodded through the backyard. They left no gates or anything, and we put up a couple no trespassing signs. But people began driving into there too. Especially when they were building it, there were a few people that ran quads right through the backyard at night. 20-30' away from the house. Obviously, that was a bit unacceptable. Now there is a whole row of large rocks across it to keep people out.

Bottom line: IMHO, it's best to find the landowner and ask permission.
