Insurance Question

I have an insurance question, i dont want any bashing, this is my sisters situation, but i wanna help her out as much as possible. Heres the deal, her boyfriend bought her an 03 Explorer for christmas this year. Its in his name because of the loan, and she put insurance on the vehicle. I dont know how he got it off the lot without insurance in his name or whatever. But heres the deal, she crashed it a few weeks back totalled it. Now they are saying they wont pay for it because the vehicle is in his name and insured in hers. My thing is, they insured it, they have the vin and she payed payments so theres no reason for her to think they wouldnt cover it. Now they arent paying anything they say. Do you think we have a case with a lawyer or are they screwed? Just figured someone on here has delt with something like this. I never have had to deal with an INS company other than paying them.

I had my Camaro in my name and insurance in my mom's name and they never said anything about it... My opinion is that they should pay being that she had it insured, I don't know though... Good luck, hope someone knows...
 
Here they absolutely wopn't insure the vehicle to you if you're not on the title.

I'd expect that they insured the vehicle so they should be on the hook for the repairs.

If I was you (or your sister) I'd be talking to a lawyer as well as doing sme research to figure out your state laws...

A lawyer would just love this kind of case. There is no way that the insurance company will get away with not paying just because the insured's name isn't on the title. Get an attorney to write a letter threatening legal action. Your sister should be able to recoup lawyer's fees as well. Insurance companies will often try to push you around hoping that you'll just go away. Don't!
 
I forgot to include this... In the past I have bought coverage for a weekend when I was testing out a friends car with the intention of buying it. I was insured as the driver for that auto with that VIN. Insurance companies are really.... difficult at times.
 
X2 on talking to a lawyer. if they are insuring it they have no choice to pay you would think.
 
lawyer! the wont insure here either unless your on the title.... either way, their mistake.
 
be careful if its a big insurance company they usually have really good lawyer(s)
 
i understand they have good lawyers but if they accepted the policy i believe its their fault, she has the ins packet saying what they cover, so if they would have realized they were wrong and not had that insurance coverage they would have had other coverage so its kind of their fault for accepting the policy.
 
The insurance company would have to pay up. They accepted the policy and agreed to take payments. Fight them a little more and try to get the coverage you had. If they still won't pay up, get a lawyer.
