Gas Company Pissing Me Off!

Looks like East Resources has found a way around us, legally.
We are not able to lease our land to the gas company due to a Conservesy, this is not a bad thing in some ways, but can be, but thats not the issue.

We are not protected from Inimant Domain, thus, they can drill THROUGH our property, knocking down our house, barns and garage and Garden (we donate for the foodbank).

Now, they want to put the line through the middle of our road and have all the permits to do it since they got them before hand, this is pissing me off.

We cannot do shit and they are going to be taking our land for NATURAL GAS!

This is the same f**king company, and by what the courthouse called a "nice owner", that got me in trouble!

Now, I am pissed as hell, what the HELL can we do?

BTW, East Resources was purchased by Shell Gas just last month.

(Oh, almost forgot to mention that we have over $5,000,000 worth of natural gas under us).

uhm, you know I am in trouble, and what for, so thats not an option, and I do NOT want to go to jail.

But as it is, we are literally F**ked. So we are able to keep he farm for MAYBE another year. If we are lucky.

They will pay us only what the value of the land was when we bought it, and we got all 138acres for $190,000 back in 2006 because we knew someone, and now the land is worth well over $300,000 on the market with over $5Mil in the ground. We own the mineral rights, and we are being kicked off our land to get it.
 
they cant give you what you paid for it way back whenever. they would have to give you fair market value at least. i would be getting a good lawyer and see what you can legally do.
 
We have a good lawyer, a VERY good lawyer, now THAT si a long story on how we got him haha.

But anyways, they can, and our Fair Market Value is whatever the county says it is. Aparently I found out that its legal for them to do that here.
 
if you own the mineral rights they can't just steal your gas.

well, already has raised hell, nothing we can do though, NOTHING, but mom is going to a board meeting tonight to hear and discuss the plans, maybe something is possible, but I doubt it.

i don't see why they would need all 138 acres, or why they would need to actually knock your house down.
 
everything is within 20' of the road
 
ok so what i found is if they take your land you have to have "just compensation" for it which means market value, they also have to be using it for public usage, or what is better for the people. i would fight on that one.

But i also found if they take your land they are responsible for all leases, stocks........ So if you take a mortgage on your house does that mean they have to pay you for it and pay the mortgage. if so double the money but im an unsure about that.

Yeah, but the water and old gas lines are owned by the township, and the permits give them the ability to use them, and since the water lines run under my property (from the watershed, but we pump our own water), they can run another line next to it or in that area.

It sounds wrong, but is true, and with Shell Oil, they are a multimillion dollar company, dad worked for Criterion Catylist, and saved the Shell company over $400,000 a year in 2006 alone.

again, might sound wrong, but they can pay for that shit, they cannot afford to have the line go around us, its not possible actually, it would be both extremely expensive, and would not work.

Also, think of this, if everyone around our property is leased but us, they convince the township that it is in the publics best interest to just "move on through".
 
they can run the lines, thats legal. they cannot take the gas from you, if you own the rights, they cant touch it.
 
You need to go to the lawmakers on this one. Contact your represenative and your congressman. That is what they are for. They work fo you.
