Anyone have any experience with getting hurt on the job? I have googled for a while but just get lawer adds...

I'm looking for info for this because my stupid brother seems to only get and take bad advice. My brother works for coke. 2 months ago he was just picking up a 12 pack and something went wrong and he could hardly walk.

Turns out it was pretty serious, herniated disc and a pintched nerve. Doctors won't let him go back to work for coke ever. And won't give more than temporary disability because he could still work so long as he does'nt pick anything up. To bad for him he's not great at much else lol.

His boss want's to get rid of him. Has texted a few times saying he needs to move on. I do know his boss can't fire him without getting sued. But my borther can't work there. Can he just agree to quit and get severance pay?

Just looking for any insight. He's just sorta stuck hoping he does'nt end up screwed.

personally id call a lawyer and find out. they will know what you can do, and will usually help you out before charging you anything.

he could agree to quit and take severence, but for the boss to text him telling him to move on is harrasment. your right, he cant fire him. but id speak with someone who knows the labor laws in your area.

I saw "My brother works for Coke" and my thoughts went the opposite direction lol.

Anyway, my brother got injured at work and they wouldn't pay for it because he kept working after it happened. He was told to keep working by his manager, who sent him home a few hours later.

On the job injuries are sticky. He needs to work with Coke and their HR department. They are bound to get him treatment. Quitting will leave him no recourse and then he'll end up a burden on society if he can't work.

There are other jobs in the company that he could be trained to do, such as to be the guy that goes out and gets the orders for the deliveries etc.

I've had that injury, it's a pain in the back for sure. Rehabable, most likely especially if he's younger. I'm going on 5 weeks and am ready to tear it up again now.

Just tell him not to quit and to talk with the company. I know that all companies don't want to deal with injuries and the process is confusing, difficult and time consuming but a good outcome is worth the effort.

I seriously doubt that the Dr. told him he can't work for Coke, probably told him he can't work lifting heavy stuff and that translated into the current job.

Good luck with this, it is not a subject to be brushed aside, it needs taken care of.

my brother got injured at work and they wouldn't pay for it because he kept working after it happened.
I broke a bone in my hand in 2 places but kept on working unloading heavy boxes. I went to emergency room after work, got the usual x-rays, Dr. notes, etc. I was told to NOT to report to work for 6 weeks by the Dr., but I took off the cast & returned in 2 weeks (honest). I got compensation from the Labor Board for time off & some for the 25% disabling injury-

Bro......OSHA is supposed to investigate work related accidents..if he got slammed by a forklift or a conveyor belt for instance. Back injury is a doctors exam, ER room for example. Did his company send him to see their doctor and get the mandatory pee test? If not....your brother is SCREWED!!!!! It will be only his word if he did not report it right away. An accident or an injury at work must be reported ASAP or the company will win every time somebody tried to sue them or collect disability claims and payments.

Exactly. This would be a Workers Compensation deal.

Sorry to say, but like Stray said, if it wasn't reported within 24 hours, he's probably not going to get much support (without legal representation).

exactly.......Coke should take care of the injury....unless his boss is the jerk of the century....in that case---MAKE Coke take care of the injury any legal wat possible....


I was injured at work because of some sharp metal scrap being left on the shop floor, and the OWNER of the small company that I worked for TOLD ME NOT TO REPORT IT==IT WOULD MAKE HIS INSURANCE GO UP....so, being young & stupid, I taped the 2" cut in my leg closed...I still have a nasty scar where it opened up a couple times....My reward for putting the company first was--no raise for the next 2 years (slow economy)

Worker's compensation laws vary from state to state.

I'm 100% sure that it is MANDATORY to report ALL accidents and any injury! Every company you can name has this policy and if his boss does not fill out a report he probably will be reprimanded though I doubt anyone will know of it.

I'm sure that a district manager or human resources will straighten out the 'boss's' attitude real quick!
