Hell yes it's their fault. You can't drive around with an unsecured load. That stupid "Stay Back" sign on the truck doesn't mean anything. It's not Jesus's crushed stone in the truck. It's going to be a civil matter. Civil matter is awesome because it's outside of criminal law and anything goes. Go to small claims with that video and stick it to them.
Some states require dump trucks be tarped. Indiana doesn't, so the trucks that break windshields should be sued all the time so they start tarping.
And now for a physics lesson.
The trucks have signs that say "Stay Back 200ft" or something. Don't do that. Tailgate the trucks. The more you let the rock coming out of the truck slow down, the harder you hit it and the more likely you are to get your windshield broken. Tailgate those tri-axles. And have video and sue them. They ARE responsible for broken windshields if you can prove it was them. No question. They didn't secure their load and it caused damage.
